Terms & Conditions

The scheduling of an appointment for the professional photographic & floorplan service confirms you have read & agreed to the terms set out below.

Delivery – The Photographer will make every effort to deliver unlimited images within 48 hours from the end of the shoot. Delivery times are given as an estimate (subject to peak times) only and Iain Gregory - IG Photography shall not be held responsible for any problems, difficulties or loss arising from any delay. Delivery of the work shall be deemed delivered when it leaves the possession or custody of Iain Gregory - IG Photography. Once the finished images are supplied to the agent, paying client or the vendor, by an electronic download link, Iain Gregory - IG Photography is under no obligation to store copies of the images (please contact to enquire if I have stored these). It is the responsibility of the agent, paying client or the vendor to back up and store all work carried out by the Iain Gregory - IG Photography. Where replacement images are available and requested by the agent, paying client, vendor or a third party acting on its behalf Iain Gregory - IG Photography reserves the right to make a reasonable charge for this service.

Copyright –  Iain Gregory - IG Photography hereby grants the agent, paying client or the vendor, limited usage of the photographs, to use or reproduce for the purposes of advertising and marketing the property for sale. Iain Gregory - IG Photography retains the copyright in all cases and is able to use the photographs in any manner at any time and in any part of the world for the purposes of advertising, selling a licensed copy for private use, complying & selling photo books or otherwise promoting their photography work. The licence doesn’t allow the distribution of residential sales images by the Agent to the property owner or connected participants.

Floorplans –  Floorplans are for illustrative purposes only. Measurements and areas shown are approximate. Iain Gregory - IG Photography will aim to provide plans that are accurate and correctly represent the rooms within the property. We do not, however, provide any guarantees, warranty or representation as to the total accuracy and completeness of the floor plan. Anyone relying on the information provided in the property details (and floor plans) should conduct a careful, independent investigation of the property to determine the suitability of the property for their requirements.

Payment – Invoices are submitted last day of the month with the previous months detailed photographic assignments. All payments are due within 10 days of issue of the invoice. Overdue accounts may be charged at a rate of 5% per 14 days past the due date, with the first charge on the 15th day after issue of the invoice, the second charge on the 29th day after issue of the invoice and so on. Any outstanding invoice that remains unpaid beyond 28 days by the client will unfortunately render the client to no longer schedule appointments until all outstanding payments and interest is paid up to date. All payments must be made by bank transfer to the specified account on the invoice. It is equally important to use the invoice number as a reference so your payment can be identified. (If your company is unable to adhere to the above payment schedule, it maybe possible to make special arrangements subject to agreement).

Client Assistance – The Client, Agent or Vendor shall assist and cooperate in obtaining the desired photographs, including but not limited to: specifying locations to be photographed and taking time to prepare the locations to be photographed. Iain Gregory - IG Photography shall not be responsible for photographs not taken as a result of the Client, Agent or Vendor's failure to provide reasonable assistance or cooperation. In the absence of prior instruction or request, the individual photographs recorded and provided will be at Iain Gregory - IG Photography's discretion. Where possible, personal photographs wall fixed may be digitally removed. (Please refer to the "Preparing your Home" section)

Confidentiality – Iain Gregory - IG Photography will keep confidential and will not disclose to any third parties or make use of material or information communicated to them in confidence for the purposes of the photography assignment.

It is the client’s responsibility to ensure that all the necessary clearances have been obtained to allow the photographs to be taken without hindrance or infringements of trademarks or copyrights. It is the client’s responsibility to gain written parental permission when persons under the age of sixteen years are to be photographed. Permission is also necessary to allow identification and publication of photographs of children. The photographer accepts no liability for non-supply of pictures if parental permission has not been granted.

Cancellation/Abortive Fee –
We understand that plans can change and you have the right to cancel or reschedule, as per the policies below:

  • You can cancel or reschedule your appointment up to three days before the photo-session time with no penalty.

  • If you reschedule with less than 48 hour’s notice prior to the photo session, we may charge a 25% fee.

  • If you cancel with less than 48 hour’s notice prior to the photo session, we may charge 50% fee.

  • If you reschedule with less than 24 hour’s notice prior to the photo session, we may charge a 75% fee.

  • If you cancel with less than 24 hour’s notice prior to the photo session, we may charge 90% fee.

  • If you reschedule with less than 12 hours prior to the appointment, we may charge 85% fee.

  • If you cancel with less than 12  hours prior to the appointment, we may charge the full amount of the photo-session. 100% fee

We put these cancellation policies in place to protect us as we lose income when cancellations occur and need to receive compensation for the time we have set aside.

Digital Print Purchases -

 

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THIS SITE OR MAKING A PURCHASE!

 

CLIENT'S USAGE

The Buyer shall only use the digital files in accordance with the permissions within this agreement. The Buyer’s digital files are for personal use only and shall not be submitted to contests, reproduced for commercial use, or reproduced in any way by parties other than the Photographer. The redistribution of digital images is strictly prohibited.

Iain Gregory - IG Photography grants Buyer a non-exclusive, non-transferable, perpetual, personal-use license to reproduce Media via print only for any non-commercial use, including but not limited to reprints, enlargements, gifts to family and friends, slide shows, and web pages. Title and ownership, and all rights now and in the future, of and for the Media remain exclusively with Iain Gregory -  IG Photography. There are no warranties, express or implied. The Media is provided "as is."

 

SOCIAL MEDIA

The Buyer may share blog post links and Facebook albums through use of the share functions and dissemination of direct links. All images posted on social media require a direct link or credit towards Iain Gregory - IG Photography. Buyer shall not copy, download, screen shot, or capture the photographs in any other fashion. Buyer also shall not crop, edit, or add filters to any photographs. This includes Facebook’s “automatic” filter. If you do so, you may be subject to a £200 cost per photo.

 

WHAT YOU MAY DO

Personal, Non-Commercial use of the Media includes:

  • Display on personal websites and computers

  • Making image prints for personal use.

 

WHAT YOU MAY NOT DO

Buyer may not:

  • Resell, re-license, sub-license, redistribute without express written permission from the Photographer

  • Use the Media in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration

  • Use the Media in advertising

  • Use the Media in a pornographic, obscene, illegal, immoral, libelous, or defamatory manner

  • Incorporate the Media into trademarks, logos, or service marks

  • Make the Media available for download

Neither Iain Gregory - IG Photography nor Iain Gregory - IG Photography's vendors will be liable for any third party claims or incidental, consequential or other damages arising out of this license or Buyer's use of the Media.

 

LICENSE

All images are property of Iain Gregory - IG Photography and are copyrighted by law. None of them cannot be copied, used, or published for commercial purposes without Iain Gregory - IG Photography's clear permission to do so. Iain Gregory - IG Photography reserves the right to use all of Client’s images on website, blogs, or any other related marketing material.

Law of Northern Ireland –

 If any part of these Terms and Conditions is found to be void or unenforceable the rest of the Terms and Conditions will still remain in full force. For the purpose of any dispute arising these Terms and Conditions will be governed by the laws of Northern Ireland.
